5.20.010 Animal Control Officer.
A. Appointment. The City Mayor shall appoint an Animal Control Officer, with the consent of the City Council who has charge of the animal shelter and the operation of the Animal Control Office. In the event that the operation of the Animal Control Office is accomplished by contract under subsection B hereof, the position of Animal Control Officer is abolished.
B. Contract for Services. The City may contract on behalf of the City for services to carry out the provisions of this title.
5.20.020 Powers and Duties of Animal Control Officer. The Animal Control Officer has the powers and the duty to execute the terms of this title in the field, subject to direction of the City Council, the power to issue citations, file complaints, and to serve citations, summons and complaints for violations of this title.
5.20.030 Records.
A. Responsibility. It shall be the duty of the animal Control Officer to keep or cause to be kept accurate and detailed records of the licensing, impoundment and disposition of all animals coming into his custody. Upon receipt of a written signed request to be made part of the City records, the City Clerk shall provide this information to anyone wishing to identify the owner of a dog. If the person requesting the information is unable to provide the registration number of the dog in question, a reasonable attempt shall be made to identify the dog from the description provided in Section 5.30.030-3-B.
B. Bite Cases. It shall be the duty of the animal Control Officer to keep or cause to be kept accurate and detailed reports of all bite cases reported to him and his investigation of the same.
C. Moneys Received. It shall be the duty of the Animal Control Officer to keep or cause to be kept accurate and detailed records of the moneys received, which records shall be open to inspection at reasonable times by persons acting for the State or the City and having responsibility for the inspection of such records.
5.20.040 Citations.
A. Issuance. Any Police Officer or Animal Control Officer may, when an animal is found running at large or otherwise in violation of any provision of this title, and when the owner of the animal is known to him, issue a citation to the owner as hereinafter provided. The issuance and control of citation books shall be in accordance with procedures and regulations approved by the City.
B. Disposition. Every Police Officer or Animal Control Officer upon issuing a citation to any alleged violator of any provisions of this title, shall deposit the original and duplicate copy thereof with the City Clerk.
C. Fines. Any person violating any provisions of this title shall be deemed guilty of a misdemeanor, and shall be punished by a fine not exceeding twenty-five dollars for the first offense, and fifty dollars upon conviction of a second or subsequent offense, or imprisonment in jail for not more than two days for conviction of a first offense and five days upon conviction of a second or subsequent offense or both such fine and imprisonment, in the discretion of the magistrate, and shall pay the cost of prosecution.
