9.12.010 Definitions. As used in this chapter, the following words shall have the following meanings:
A. "Motor vehicle" means a vehicle which is self propelled except one propelled by human or animal power.
B. "Snow machine" means a vehicle propelled by mechanical power, supported in part by skis, belts, cleats, one or two tracks, or low-pressure tires and includes "three wheelers" and "four wheelers" and all-terrain/track vehicles.
C. "Safe speed" means the maximum rate of travel at which a reasonable person would operate a motor vehicle or snow machine under conditions prevailing at that time and never exceeding the posted speed limit. (Ord. 106 §6.06.00, 1984)
9.12.020 Motor vehicle laws applicable. A person operating a snow machine upon or along a city roadway shall be granted the same rights and is subject to the same duties applicable to the driver of other motor vehicles by the traffic regulations, statutes and ordinances, except as to special regulations in this chapter. 9.12.030 Hours of operation. No snow machine shall be operated within the municipality between the hours of nine p.m. and seven a.m. except in going to or returning from an evening ride or activity outside of the city or to use the vehicle as transportation to work. (Ord. 106 §6.06.10, 1984)
9.12.040 Rules of operation. A. A snow machine operating in the city limits shall operate at a safe speed, as defined in this chapter, at all times.
B. Snow machines shall travel only in single file on streets and alleys.
C. A snow machine shall carry passengers only when adequately equipped to do so.
D. Snow machines shall not tow any person or persons, but may carry additional passengers by sled or skid, the tongue of which is attached directly to the snow machine and is designed to do so.
E. Both driver and passengers shall wear helmets while operating a snow machine in the city.
F. A snow machine shall not pass any vehicle while travelling on the streets of the city, except to pass a vehicle parked or standing, and then with all due care and signals.
G. Snow machines shall not be operated on school grounds, public parks, ski trails or on private property without permission of the owner of the property. Further, no snow machine shall be operated on that part of the highway that comes into town and ends at "A" Street (hard top road).
H. Periodically, the city will close certain streets or areas during the construction season or during emergency situations. These areas will be announced and posted at the city building. (Ord. 106 §6.06.15, 1984)
9.12.050 Required equipment. A snow machine operated in the municipality is required to have the following equipment:
A. Lights and Reflectors.
1. At least one headlight, aimed and of sufficient intensity to reveal persons and vehicles at a distance of one hundred feet ahead.
2. One red light, one stop-signal light and one red reflector, which must be mounted upon the rear of the vehicle. The lights must be visible from a distance of at least one thousand feet to the rear. The reflector must be visible from a distance of at least six hundred feet.
B. Brakes. Snow machines must be equipped with brakes which will control the movement, stop, and hold the vehicle under normal operating conditions.
C. Throttle. Snow machines will be equipped with a throttle which, when released by hand, will return the engine to idle and disengage the clutch.
D. Muffler. Snow machines will be equipped with an exhaust muffler in good working order.
E. Other Equipment. All snow machines will have snowflaps behind tracks or wheels, protective shields over all moving parts, and a spark arrester. (Ord. 106 §6.06.20, 1984)
9.12.060 Enforcement. This chapter will be enforced by any means legally available to the city. (Ord. 106 §6.06.30, 1984)
9.12.070 Penalties. Any person who violates any section of this chapter is guilty of a violation and, upon conviction, is punishable by a fine of not more than one hundred dollars for each offense. (Ord. 106 §6.06.25, 1984)
