2.04.010   Legislative powers.   All legislative powers of the city are vested in the city council, which shall be composed of seven elected residents of the city.  The council shall elect a mayor from its members who shall preside over meetings, and hold office for a duration of his/her term.             2.04.020   Terms of Office.  The city council shall consist of seven members.  Council seats are designated and terms expire as follows:

 

            Seat A  -  term expires 1993,   then 1995,   1995,   etc.;

            Seat B  -  term expires 1993,   then 1995,   1997,   etc.;

            Seat C  -  term expires 1993,   then 1995,   1997,   etc.;

            Seat D  -  term expires 1994,   then 1996,   1998,   etc.;

            Seat E  -  term expires 1994,   then 1996,   1998,   etc.;

            Seat F  -  term expires 1994,   then 1996,   1998,   etc.;

            Seat G -  term expires  1994,   then 1996,  1998,   etc.;.

           

When appointments are made to fill vacancies in the manner provided by Section 2.28.030, appointees shall qualify for and assume the duties of office within 10 days after the appointment.

            2.04.030   Meetings.  A.  Regular meetings of the city council shall be held on the first Tuesday of each month.  B. Special meetings may be called by either the mayor or two council members with a majority of the council members' receiving a minimum of twenty-four-hours notice and (i) there has been a reasonable effort to notify all members, and (ii) all members are willing to waive the required notice either before of after the meeting is held.  (Ord. 04-02; Ord. 113 §4(B), 1986:  Prior code AO §2.01.05; Ordinance 02-01.)

2.04.040   Meeting Procedure.  All meetings shall be conducted pursuant to Robert's Rules of Order, or in substantial compliance therewith.  (Prior code AO §2.01.35)

 

2.04.050   Quorum.  A quorum of the city council consists of four members.  All actions requiring council approval require four affirmative votes.  (Prior Code AO §2.01.10)

 

2.04.060   Ordinances.  Ordinances shall be used to:

            A.   Change or establish laws;

            B.   Provide for fines and penalties;

            C.   Clarify and establish matters of uniform policy;

            D.   Establish, raise or alter any tax;

            E.   Establish any board, authority or commission.

2.04.070   Ordinance Procedure.  All ordinances shall be read aloud, or a copy provided for each person, when introduced to the council, and set for public hearing with or without amendments.  Public notice of such hearing shall be conspicuously posted in at least three public places, together with a text of the proposed ordinances and the time and place of the hearing for at least ten days if there is no newspaper of general circulation distributed in the city.  If there is a newspaper of general circulation in the city a summary of the ordinance must appear in it. At the public hearing, copies of the proposed ordinance shall be made available, and all interested persons may appear and speak.  The proposed ordinance may be adopted with or without amendments.  (Ord. 04-02; Ord. 113  §C, 1986; Prior code AO §2.01.20)

2.04.080  Resolutions.  Resolutions shall be used for matters of a specific or temporary nature.  (Prior code AO §2.01.25)

2.04.090  Motions.  Motions shall be used to approve specific actions or policies, or to direct any official to take a course of action.  (Prior code AO §2.01.30)

2.04.110  Procedures.  The rules or regulations shall be presented to the city council, but shall be publicly posted in the same manner as ordinances, for fifteen days before presentation to the council. At the time, such rules or regulations may be rejected, adopted or amended by the council, pursuant to appropriate statutes and regulations. (Ord. 100 §5.03.05, 1981)

2.04.120  Adoption.  A. Rules and regulations, after adoption by the city council, become effective after a period of fifteen days, unless, objection is made in writing and submitted to any city official.  In such cases, the effectiveness of the adoption rules and regulations specifically objected to shall be stayed until the next regular council meeting, at which time the rules and regulations shall become effective, unless amended or repealed by the council. B.  Publication of rules, after adoption by the council, shall be in the same manner as ordinances.  (Ord. 100 §5.03.10, 1981)

2.04.130  Emergency ordinances.   Emergency ordinances may be enacted by the city council, effective upon adoption, to meet a public emergency.  Every emergency ordinance must contain a finding by the council that an emergency exists and a statement of the facts upon which the finding is based.  Such emergency ordinances may be effective for no more than sixty days.  (Ord. 113 §4(P), 1986:  Ord. 100 §5.03.15, 1981)
